Enugu East: Court dismisses case against Nnamani's candidacy

The Federal High Court sitting in Enugu, Thursday, dismissed the suit challenging the eligibility of a former governor of Enugu State, Dr Chimaroke Nnamani,  to contest Enugu East senatorial election on the platform of the Peoples Democratic Party, PDP. 

One Chukwunonso Ogbe had approached the court asking it to  disqualify the first defendant, Dr Nnamani from participating in the election on the ground that he (Nnamani) did not appear in person to sign his senatorial nomination form. The PDP was joined as one of the defendants in the case. 

But counsel for the defendant, Onyechi Ikpeazu, SAN, had while arguing the motion, urged the court to dismiss it for lacking in merit. 

He contended that the matter was status barred having been filed out of time just as he further told the court that the plaintiff had no locus standi to institute the action. 

However, in a detailed judgment delivered Thursday, the presiding judge, Justice Buba Mohammed, upheld the preliminary objection raised by Dr Nnamani's counsel and consequently dismissed the case. 

He held that the plaintiff's case had no foundation, adding that it lacked substance and was misconceived.

He awarded a cost of N250,000 in favour of the first and second defendants.
